Jurisdiction Stripping

Definition

When Congress passes a law that takes away — or 'strips' — federal courts' power to hear certain types of cases or review certain government decisions, especially in immigration law.

Examples

• •The government argues that provisions of the Immigration and Nationality Act strip courts of jurisdiction to second-guess how CBP officers manage the flow of people at ports of entry.
