Intentional Infliction of Emotional Distress (IIED)

Definition

A tort claim where a plaintiff alleges that a defendant's extreme and outrageous intentional or reckless conduct caused the plaintiff severe emotional distress. It requires more than ordinary rudeness or insensitivity.

Examples

  • Konan's IIED claim is based on the alleged campaign of racial harassment carried out through deliberate mail withholding, which the government concedes may not need to be resolved in this case.
