Consecutive sentences

Definition

Prison terms that must be served one after the other rather than at the same time (concurrently). Section 924(c)(1)(D)(ii) mandates that any sentence imposed under § 924(c) must run consecutively to any other sentence, which the amicus argues shows Congress intended cumulative punishment.

Examples

  • Section 924(c)(1)(D)(ii) states that no term of imprisonment imposed under § 924(c) shall run concurrently with any other term, but petitioner argues this only addresses how a sentence runs, not whether a dual conviction is authorized in the first place.
